Welcome to VibSafety Learning. By accessing or using our platform, services, content, or products (collectively, the “Services”), you (“You”, “Your Organization”, or “Client”) agree to be bound by the following Terms and Conditions.
1. Using Our Services
Eligibility
Our Services are intended for use by business entities, training managers, HSE supervisors, and employees of subscribed organizations. You must ensure your organization has proper authorization to use the platform on behalf of its users.
License to Access
VibSafety grants a non-exclusive, non-transferable, and revocable license to access and use our platform and its training content for internal organizational training purposes only.
Account Security
Organizations and users are responsible for maintaining the confidentiality of their login credentials and for all activities under their account.
Prohibited Use
You may not:
- Reproduce, resell, or redistribute content for commercial use outside your organization.
- Attempt to reverse-engineer, disrupt, or overload the platform.
- Upload malware or malicious content to the platform.
2. Your Content in Our Services
Uploaded Content
Organizations may upload custom training videos, documents, or other instructional materials to the platform (“User Content”).
Copyright and Responsibility
By uploading any User Content, you represent and warrant that:
- You have all necessary rights and permissions to share the content.
- The content does not infringe upon intellectual property, privacy, or confidentiality rights of others.
- The content complies with applicable laws and safety standards.
License to VibSafety
By submitting content to VibSafety, you grant us a limited, non-exclusive, royalty-free license to store, host, and deliver the content to your authorized users solely for training and operational purposes. We do not claim ownership of your uploaded content.
Confidentiality of User Content
All custom content uploaded to your organization’s instance of VibSafety will be treated as confidential and will not be shared with third parties or other platform users without explicit written consent.
Platform Content Ownership
All pre-built training materials, video content, graphics, documentation, and related assets created by VibSafety are protected by intellectual property laws and remain the sole property of VibSafety Technologies.
3. Changes to These Terms
Notice of Change
VibSafety reserves the right to update or modify these Terms and Conditions at any time. We will notify clients of significant changes through email or in-platform announcements.
Continued Use
Continued use of the Services after any such changes constitutes your acceptance of the updated Terms.
4. Termination and Suspension
VibSafety reserves the right to suspend or terminate access to the platform for:
- Violation of these Terms.
- Non-payment of subscription or license fees.
- Legal or regulatory requirement.
Upon termination, any licenses granted to use our Services will immediately cease.
5. Disclaimers and Liability
- Training Support: While our content is based on regulatory standards and expert knowledge, it is intended to supplement — not replace — organizational safety procedures and legal obligations.
- No Warranty: VibSafety makes no warranties regarding uninterrupted access or absolute accuracy of content.
- Limitation of Liability: VibSafety shall not be liable for indirect, incidental, or consequential damages arising out of the use or inability to use our Services.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where VibSafety Technologies is incorporated, without regard to conflict of law principles.
